Baker Sterchi Secures Summary Judgment for Heavy Equipment Manufacturing Client

On September 22, 2021 Baker Sterchi secured summary judgment in favor of a heavy equipment manufacturing client in the United States District Court for the Eastern District of Missouri. Plaintiff fell approximately 12 feet from a large piece of earth moving equipment to the ground below breaking his feet and injuring his back. He claimed the safety railing and emergency egress gate that was a part of the railing was defectively designed and manufactured, allowing the gate to open unexpectedly when contacted. Our investigation disclosed that the gate had been damaged and partially repaired after it was sold and before the accident occurred. Baker Sterchi argued that plaintiff could not prove that his fall could have occurred on the as-designed and manufactured equipment and, as such, he could not establish causation. The Court agreed and entered judgment in favor of our client.
