David Eisenberg Quoted in St. Louis Record Article Regarding Missouri Punitive Damages Caps

Baker Sterchi Member David Eisenberg is quoted in a St. Louis Record article titled “Missouri Supreme Court upholds cap on $5.5 million punitive jury trial damages award,” concerning a recent Missouri Supreme Court decision to uphold a circuit court’s ruling in favor of capping damages on plaintiff’s claims for tortious interference and breach of the duty of loyalty.

The publication quotes Eisenberg as saying, “I was actually somewhat surprised by the Western District Appellate Court’s reversal of the trial court decision [but] thought it was likely that the Supreme Court would take the course that it did.”

For a more detailed discussion of the case at issue, All Star Awards v. HALO Branded Solutions,  see Eisenberg’s recent Missouri Law Blog post titled "No Surprise: the Missouri Supreme Court Upholds the Constitutionality of the Statutory Punitive Damages Cap, as Applied to Claims for Breach of the Duty of Loyalty and Tortious Interference.”

Eisenberg has over thirty years of experience representing Fortune 100 and other companies in employment and labor law matters, consumer and general business litigation, and appellate litigation. He is the editor of Baker Sterchi’s Missouri, Employment & Labor, and Product Liability blogs and has served on the Editorial Board of the ABA Appellate Practice Committee, and on that Committee’s Appellate Rules subcommittee.

The St. Louis Record, a publication of the U.S. Chamber Institute for Legal Reform, covers the legal system, focusing on civil actions in the St. Louis area.
