Baker Sterchi Obtains Summary Judgment on Behalf of County Government in Claim Involving Helicopter


In this St. Louis City action, plaintiff’s decedent was killed in a motor vehicle accident when a stolen vehicle collided into decedent’s vehicle. Plaintiff alleged that the driver of the vehicle was being pursued by police at the time of the crash, including a county helicopter operated by a pilot officer. Baker Sterchi obtained summary judgment for its client, the county, by arguing that plaintiff was unable to plead the requisite element of proximate cause because the helicopter operations at issue were not physically involved in the underlying accident.
