A unanimous defense verdict was obtained by our attorneys for a Doctor of Podiatric Medicine (Doctor) and an Advanced Practice Nurse Practitioner (APNP) in a medical malpractice case.
The plaintiff alleged that the Doctor and APNP failed to properly monitor and assess the condition of his left leg after tarsal tunnel syndrome surgery, leading to an amputation. He claimed the defendants were negligent in pre-surgical assessment and testing, and in failing to recognize post-operative ischemia.
Over the four-day trial, the defense team demonstrated that the Doctor and APNP provided care consistent with the standard of care. They emphasized that multiple independent medical evaluations confirmed adequate vascular perfusion in the plaintiff’s leg between the surgery and amputation. Expert testimony further indicated that the plaintiff’s undiagnosed stomach cancer, subsequent treatment, and resulting malnutrition were unforeseen factors beyond the defendants’ control that contributed to the outcome.
Ultimately, the jury returned a unanimous no negligence verdict for the defendants.
