Our attorneys, working in coordination with multiple other defense counsel, successfully secured a unanimous defense verdict in a medical malpractice matter involving allegations that doctors and hospital staff failed to recognize symptoms of a stroke. The case had been pending for nearly five years.
The plaintiff presented to the emergency department with mild symptoms. After a complete work up based on the history provided, she was discharged with instructions to follow up with her primary care provider. Four days later, she suffered a significant stroke resulting in permanent disability. The plaintiff claimed her symptoms during her emergency department visit were much more severe than previously documented.
During the two-week trial, the plaintiff's experts contended that minor stroke symptoms should have been treated with anticoagulants immediately upon presentation. The defense presented highly credentialed experts who explained the appropriate standard of care and treatment options for minor stroke symptoms. They successfully demonstrated that the nurse practitioner who initially saw the plaintiff, the nurses and hospital staff involved, and the reviewing physician all provided care consistent with the standard of care.
The jury returned a unanimous defense verdict in just over two hours.
