Representative Experience:

  • Obtained dismissals or nominal settlements in numerous premises liability cases alleging asbestos exposure by leveraging pending dispositive motions, including personal jurisdiction, motions to bar based on workers’ compensation, and motions for summary judgment.
  • Appeared at hundreds of toxic tort depositions involving multiple defendants on behalf of numerous clients, including conducting lead examination of the plaintiff on behalf of all defendants in more than a dozen cases.
  • Successfully obtained a favorable settlement for a pipe manufacturer in an asbestos exposure case by aggressively preparing the case for trial, including drafting multiple motions in limine and dispositive motions, leading the plaintiffs to drastically reduce their settlement demand and ultimately settle for significantly less than other similar-situated defendants.
  • Defeated a motion to dismiss based on sovereign immunity in favor of a runner shot and injured by a hunter in a public recreation area; the judge agreed that the presence of invited, licensed and regulated hunters created a dangerous condition on public land, qualifying as an exception to Missouri's sovereign immunity statute.
  • Obtained a favorable mediation result for a trucking company that experienced a total loss of its trailer due to a downed power line, despite facing a potentially strong sovereign immunity defense.
  • Drafted a federal class action complaint representing a group of airline pilots, alleging a breach of their union's duty of fair representation during collective bargaining negotiations, which ultimately resulted in a favorable recovery for the pilots.
  • Actively represented a government agency in bankruptcy court to obtain orders declaring debts to the agency non-dischargeable due to fraud, including obtaining a favorable order after conducting a solo trial on the issue.
