Construction Trial & Litigation

We aren’t just construction trial lawyers, we are also trusted industry advisors, deeply committed to our clients. We mediate, litigate and arbitrate highly complex construction disputes on behalf of general contractors, subcontractors and design professionals on matters involving delay and interruption claims, scope of work disputes, unforeseen conditions, federal contract disputes, professional negligence, surety bond claims, and much more. We are licensed or pro hac vice in nearly every state and have offices throughout the United States. Our national experience is based on decades of knowledge involving a wide-range of local, state and federal construction matters. Our background in surety law and complex business and transactional matters, coupled with our years of experience as trial lawyers and arbitrators, provides a unique skill set and perspective to the practice of construction law.

We are involved with every phase of construction, from assisting with management, documentation and close-out of troubled projects, to planning, designing and implementing work outs and dispute resolution. Our services include contract drafting and review, advising on design and project delivery methods, resolving labor and Union disputes, advising on successor liability issues, handling high-stakes delay and scheduling claims, advising on delegated design, negotiating takeover and completion agreements, and preparing, filing and defending mechanic’s liens and Miller Act suits. We also guide clients through bonding requirements and surety bond claims, every step of the way.

Our team also has a thorough understanding of government contracting requirements, Contract Disputes Act claims, bid disputes and negotiation of final change orders. We helped write the books on design-build and delegated design, and we have firsthand knowledge of construction disputes involving some of the most widely-recognized projects in the country, including hospitals, Veteran’s projects, industrial plants, multi-family and large-scale residential projects, commercial projects, schools and much more. We know how to navigate claims governed by federal contracts and federal regulations, including those before the Armed Services Board of Contract Appeals and the U.S. Court of Federal Claims.

Our construction and labor lawyers are uniquely qualified to investigate and manage internal claims, including federal false claims, and with ensuring compliance with all relevant legal standards, understanding labor jurisdictional and legal issues, and protecting our clients' business interests. We are equally skilled at helping clients proactively manage risks by offering training sessions focused on contracts, supply chain issues, documentation, surety matters, labor relations, mechanic’s lien laws, employment contracts and workplace regulations.

Because we are arbitrators and trial lawyers, we understand that when disputes arise, your business is best suited to avoid the risk and costs of protracted litigation. Our focus is on delivering tailored solutions that help clients avoid costly litigation. We collaborate closely with outside consultants as needed, ensuring a robust defense and strategic approach to claim resolution. But if tested, we litigate with confidence and vigorously advocate for our clients’ best interests to support their success on that project and beyond.
