Defense Verdict Secured in Favor of Anesthesiologist and Hospital in Facial Scarring Malpractice Case

In a medical negligence lawsuit, our attorneys secured a unanimous defense verdict for an anesthesiologist and hospital system. Before trial, they also successfully obtained dismissal of the defendant neurosurgeon on a motion for summary judgment.

Plaintiff claimed disfigurement from facial scarring sustained during a three-level lumbar fusion surgery, alleging the anesthesiologist was negligent in monitoring and positioning his head during the lengthy surgery.

The defense maintained that pressure injuries were an accepted risk of the surgery and were almost inevitable given the plaintiff’s medical history and risk factors for perfusion-based injuries.

In closing argument, plaintiff’s counsel suggested damages of up to $600,000. After roughly 20 minutes of deliberation, the jury found no negligence by the anesthesiologist and awarded no damages.
