Favorable Verdict Obtained in Missouri State Court Breach of Contract Action


After a two-week jury trial in Jackson County, MO, in a contractual dispute with claims and counterclaims of breach of contract, fraud, conversion, and civil conspiracy, Baker Sterchi successfully obtained a favorable verdict for an employee of a co-defendant concrete company.

The case involved a dispute between partners of a concrete company after a senior partner retired and a restructuring of the company. Plaintiffs claimed 100% ownership after the restructure, which defendants disputed should be 60%. A third-party claim of negligence per se was also brought against our client, the concrete company employee, alleging failure to follow notary public statutes.

The plaintiffs’ pre-trial demand against our client’s co-defendants was for $5 million. The third-party plaintiff claimed damages of $200,000 for the alleged notary violations. In the third-party plaintiff’s claim of negligence per se against the employee notary, the jury rendered a favorable verdict for our client with no damages awarded.
