Jury Finds in Favor of Urological Oncologist in Kidney Mass Malpractice Case


A defense verdict was obtained by our attorneys in a case involving a urological oncologist accused of malpractice in his management of a kidney mass. The mass was initially discovered incidentally on a CT scan done to evaluate ongoing gastrointestinal issues. Based on its characteristics consistent with a benign cystic mass, surveillance with periodic imaging was recommended.

Over the next two years, multiple follow-up CT scans showed no enhancement or change in the mass, consistent with a benign lesion. However, during a follow-up scan in 2018, it was discovered that the patient had developed extensive metastatic kidney cancer.

The plaintiff alleged that the physician was negligent in assessing the mass as low risk for malignancy and in failing to properly inform the patient about the potential risk and treatment options.

Following a six-day trial, the jury deliberated for approximately 35 minutes before returning a verdict in favor of the physician on all counts.
