Surety & Fidelity
Our attorneys have a well-established national reputation as leaders in surety law. With a team of highly experienced surety and construction lawyers licensed across multiple states, we are well-equipped to efficiently and effectively handle the many facets and complexities of suretyship and fidelity matters.
We get involved long before litigation ensues to help manage and complete troubled projects at the local, state and federal levels, challenge bond default and termination claims, handle and resolve bond claims, file UCC-1 Financing Statements and take other measures to protect our clients’ interests and to avoid losses, all with the goal of avoiding protracted litigation.
Because we are licensed or pro hac vice in nearly every state, we routinely serve as lead counsel for national and international surety companies to assist with resolution every step of the way, including helping to choose local counsel if needed. We are uniquely adept at handling defaults and terminations on federal projects given our experience with navigating claims governed by federal contracts and federal regulations, including those before the Armed Services Board of Contract Appeals and the U.S. Court of Federal Claims.
We also have decades of experience in defending clients against bad faith claims and in handling indemnity actions. We are uniquely skilled at locating assets and unraveling the most complex webs of indemnitor efforts at asset protection. Our team investigates, perseveres and recovers losses by leveraging our experience in complex business and fraudulent transfer litigation.
Additionally, we draft and negotiate essential agreements, including financing and workout, tender, takeover and other critical agreements to ensure bond claims are managed with precision and efficiency and that losses are mitigated. Our team handles disputes involving all types of surety bonds, including commercial bonds, contract bonds, bid bonds, licensing and permit bonds, mechanic’s lien and Miller Act bonds, subdivision bonds, financial and fidelity bonds, probate and motor vehicle dealer bonds, public administrator bonds, cow bonds, as well as virtually all other types of bonds.
