Unanimous Defense Verdict Returned in Retinal Detachment Surgery Malpractice Case Alleging Blindness
On April 9, 2026, Baker Sterchi Wisconsin attorneys secured a unanimous defense verdict in a medical malpractice case in Brown County Circuit Court. The plaintiff alleged that during a 2021 retinal detachment surgery, the incorrect intraocular gas was used, resulting in elevated intraocular pressure and permanent blindness in one eye. Plaintiff claimed the defendants failed to meet the standard of care and sought damages for the significant and permanent injury and loss of vision.
The defense maintained that the correct gas and concentration were used, and that the plaintiff’s outcome was caused by a known but rare postoperative complication known as aqueous misdirection. The defense maintained that syndrome led to the drastic increase in intraocular pressure and resulting blindness in that eye.
After hearing the evidence, which included medical experts from around the country, the jury returned a unanimous defense verdict after less than two hours of deliberations, finding no negligence.
